Open Source Entertainment, LLC (“Open Source Entertainment” or “OSE”) owns the “Open Source Entertainment” Website, www.OpenSourceEnt.com (the “Website”), and includes all web pages whose domain name contains: “OpenSourceEnt.com.” Open Source Entertainment is committed to protecting the personal information that you provide and entrust to us when using the Open Source Entertainment Website. This online privacy statement (the “Privacy Statement”) describes how we treat all user data collected by the Website during your visit to the Open Source Entertainment site, both technical data that is automatically collected and voluntarily submitted data.
Open Source Entertainment may also operate other websites that don’t contain the Open Source Entertainment.com domain names. This Privacy Statement does not apply to those websites (unless those websites specifically link to this Privacy Statement) and the terms of the privacy statements for those other Open Source Entertainment websites may differ from the terms of this Privacy Statement. This Privacy Statement does not apply to blogs, forums or social networking sites where Open Source Entertainment has a presence, but that are not on the Open Source Entertainment site.
User Data We Collect
We collect two types of user data: (1) technical data that is automatically collected from all visitors to the Open Source Entertainment Site (“Log Data”); and (2) data that you voluntarily submit to us (described below under \"Personal Information\").
Log Data. If you do nothing during your visit except browse through our Website, read pages, or download information, we will gather and store certain information about your visit automatically. This information does not identify you personally. We automatically store the following information:
1. The Internet domain (for example, \"xcompany.com\" if you use a private Internet access account, or \"yourschool.edu\" if you connect from a university\'s domain) and IP address (an IP address is a number that is automatically assigned to your computer whenever you are surfing the Web) from which you access our Website.
2. The type of browser and operating system used to access our site.
3. The date and time you access our site.
4. The pages you visit.
5. If you linked to www.OpenSourceEnt.com from another website, the address of that website.
We use this information to help us make our site more useful to visitors---to learn about the number of visitors to our site and the types of technology our visitors are using. We do not track or record information about individuals and their visits.
Personal Information. If you choose to provide us with Personal Information by filling out our \"contact us\" form, become a member using the Open Source Entertainment services, or if you send an email to us, we use that information to contact you. Personal Information includes, but is not limited to, your name, username, phone number, credit card or other billing information, email address and home and business postal addresses, and any other information that you decide to provide to Open Source Entertainment that could be used to personally identify you. We use your Personal Information for business purposes, which mainly include operating the Open Source Entertainment Website, registering End Users to the Open Source Entertainment Service as Members, providing the Open Source Entertainment Service, responding to correspondence from you, and when you participate in certain activities on the Open Source Entertainment site, including when you:
• join or renew your membership to any Open Source Entertainment program;
• sign up for our Open Source Entertainment e-mail network;
• order items from the Open Source Entertainment store;
• register for our message board;
• register online for an event;
• participate in one of our online complaint forms or surveys;
• post a blog comment
• submit feedback to Open Source Entertainment; or
• participate in any activity that requires personal information.
We may also combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other End Users to attempt to provide you with a better experience, to improve the quality and value of the Open Source Entertainment Service and to analyze and understand how the Open Source Entertainment Service and Open Source Entertainment Website are used.
Under no circumstances will we supply information in our database to a third party except as described below. In fact, if we select you to receive an informational email from us, we will give you the opportunity to unsubscribe from the list.
We may transfer a Long-term Cookie only if you are notified prior to the cookie being stored and allow the transfer of the cookie. We may use Session Cookies whenever you visit the Open Source Entertainment site to analyze our Website traffic or for the Website’s interactive applications. Session Cookies last only as long as your session on the Open Source Entertainment site. We also may use Short-term Cookies are set to expire within one hour of their being placed on your hard drive.
To the extent that Open Source Entertainment operates multiple websites, we may use a separate cookie to track each site\'s aggregated page, which tells us which features are most interesting to End Users. The cookies that the Open Source Entertainment Website uses do not store Personal Information, but they may store Non-Identifying Information. The Open Source Entertainment Service and Open Source Entertainment Website will not at any time expose any files or personal information on your personal computing device or other hardware to Open Source Entertainment or other third parties or otherwise enable Open Source Entertainment or any other third party to have direct access to any of the files or personal information on your personal computing device or other hardware.
Open Source Entertainment and its service providers use Secure Sockets Layer (SSL) encryption on all Web pages of the Open Source Entertainment Website where Personal Information is required to effect a monetary transaction. Open Source Entertainment and its service providers use SSL encryption and otherwise exercise reasonable care in providing secure transmission of information from your personal computing device to our servers and ensuring the security of your information on our systems. To use the Open Source Entertainment Service or to otherwise make purchases from Open Source Entertainment, you must use an SSL-enabled browser to protect the confidentiality of your personal and credit card information while it is transmitted over the Internet. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we take steps to protect your information, Open Source Entertainment cannot ensure or warrant the security of any information you transmit to us, and you do so entirely at your own risk.
How We Use the Data We Collect
Log Data is collected automatically by the Open Source Entertainment Website servers and related software. Because the Open Source Entertainment Website automatically collects Log Data for all End Users that visit the Open Source Entertainment Website, your Open Source Entertainment Website session will be tracked. Because we do not match Log Data with Personal Information, you can remain anonymous in public areas of the Open Source Entertainment Website. You can browse those areas of our Open Source Entertainment Website without entering any Personal Information and, therefore, remain anonymous during your visit.
Additionally, in some of our email messages, Open Source Entertainment may use a “click-through URL” linked to content on the Open Source Entertainment Website. When an End User clicks onto one of these URLs, the End User will pass through our Web server before arriving at the destination Web page. Open Source Entertainment tracks this click-through data to help us determine End User interest in certain subject matter and measure the effectiveness of these End User communications. You can avoid being tracked in this way by not clicking text or graphic links in emails from Open Source Entertainment.
Finally, we may use clear gifs or pixel tags, which are tiny graphic images, in order: (i) to advise us of what parts of the Open Source Entertainment Website End Users have visited, (ii) to measure the effectiveness of any searches End Users perform on the Open Source Entertainment Website, and (iii) to enable us to send emails in a format that End Users can read and tell us whether such emails have been opened in order to ensure us that we are sending messages that are of interest to End Users.
The End User information that Open Source Entertainment collects may be added to our databases and used for business purposes, including for marketing and promotional purposes, for a statistical analysis of End Users\' behavior, for product development, for content improvement, or to customize the content and layout of our Open Source Entertainment Website. In addition, Open Source Entertainment will, on occasion, send emails to you about our services or third-party products. Third Party Disclosures
We do not disclose identifying information to any third parties, except under the following circumstances:
IT Service Providers. Your information may be available to third parties providing computer system administration services, maintenance or other services to our firm Websites, networks, servers, communications or databases. However, under no circumstances do we permit such third parties to use that information for other purposes.
Legal Requirements. We may provide your information to governmental agencies or other third parties as required by law and regulations, including responding to subpoenas, court orders or other legal processes. We additionally may release End User information when we believe, in our sole discretion, that release is appropriate: including but not limited to, to enforce or apply the Agreement, including the Terms of Service and other agreements, rules, and policies; to protect the rights, property, or safety of Open Source Entertainment, our End Users, or others; or to prevent activity that we believe, in our sole discretion, may be or may become illegal, unethical, or legally actionable (including exchanging End User information with other companies and organizations for fraud protection).
Business Partners and Service Providers. We work closely with certain business partners and service providers and we may provide End User information to our business partners and service providers so that they can provide services to you. For example, we may provide End User information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you. We may also employ third party companies and individuals for any of the following: to facilitate the Open Source Entertainment Website or Open Source Entertainment Service; to provide the Open Source Entertainment Website or Open Source Entertainment Service on our behalf; to perform related services, including without limitation, maintenance services, database management, fulfillment, web analytics, and improvement of the features or functionality; or to assist us in analyzing how the Open Source Entertainment Website or Open Source Entertainment Service is being used.
You may avoid having Open Source Entertainment share your information with its business partners and service providers by not granting Open Source Entertainment permission to share your information. Not granting Open Source Entertainment permission to share your information with its business partners or service providers may limit your access to their services through the Open Source Entertainment Website.
Business Transfers. As we continue to develop our business, we may buy, sell, or share assets in connection with, for example, a merger, acquisition, reorganization, a sale of assets, or bankruptcy. In such transactions, information about End Users generally is often a transferred business asset. In the event that Open Source Entertainment itself or substantially all of Open Source Entertainment’s assets are acquired, information about our End Users may be one of the transferred assets.
Aggregate Site Use Information. We may release aggregate End User information (without revealing any Personal Information about you) to advertisers and other third parties in order to promote or describe use of the Open Source Entertainment Website or the Open Source Entertainment Service.
Changing or Deleting Your Information
All Members may review, update, correct or delete the Personal Information in their registration profile by contacting us. If you completely delete all such information, then your account may become deactivated. We may retain an archived copy of your records as required by law or for legitimate business purposes.
Our Website is directed to businesses, government agencies and adult individuals who may be interested in our services. The Website is not intended nor designed to collect personal information from children under 14 years of age or as otherwise provided under the Children’s Online Privacy Act of 1998 (http://www.ftc.gov/ogc/coppa1.htm), The Open Source Entertainment Service and Open Source Entertainment Website are not intended or designed to attract children under the age of fourteen (14). Any access to or use of the Open Source Entertainment Service or Open Source Entertainment Website by anyone under the age of thirteen (14) is unauthorized, unlicensed, and in violation of the Agreement. By using the Open Source Entertainment Service and Open Source Entertainment Website, you represent and warrant that you are fourteen (14) years of age or older and that you agree to and agree to abide by all of the terms and conditions of the Agreement. If Open Source Entertainment believes that you are under the age of fourteen (14) or that you are not old enough to consent to and be legally bound by the Agreement, Open Source Entertainment may, at any time, in its sole discretion, and with or without notice: (i) terminate your access to or use of the Open Source Entertainment Service or Open Source Entertainment Website (or any portion, aspect, or feature of them), or (ii) delete any content or information that you have posted on the Open Source Entertainment Website.
We follow security measures to prevent unauthorized access to your information that is provided to us through our Website. Although no system connected through the Internet can be absolutely guaranteed to be secure, we employ generally accepted business practices to secure your information through our Website, network and servers. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on the Open Source Entertainment Website in the most expedient time possible and without unreasonable delay, as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
Accuracy of Your Information
We use reasonable efforts to accurately store and record your data accurately when it is submitted to us through the Open Source Entertainment Website. We do not assume any responsibility for verifying the ongoing accuracy of identifying information after it has been submitted to us.
